My question is, if the short arm is in fact 5 1/4" in length, will the 39-031 work? If so, I would just order it and take off the old one and put on the new one at the same time.

I think the 39-031 should work on your window. However, you would need to move the sash bracket over a bit to meet the short arm. Another option would be to see if you could swap out the new link arm with your 5-1/4" arm.

If I would purchase the one that is closest in size to my mine, even though the short arm is smaller in length, will it still fit in my window and would it work to open and close the window even if it isn't the same size? If yes, the clip on my is on the bottom of the short arm and yours is on top - will that be a problem?

We can't make any guarantees but the 39-031 would be our best replacement option. There is a good chance that you could adapt this operator to work for your repair as long as you are able to adjust the position of the sash bracket to compensate for the difference in the length of the link arm. As for the detach clip, you should be able to take it off and reattach it on the bottom of the arm if needed. To use the 39-031, you would most likely need to move the sash bracket towards the operator 13/16" to compensate for the difference in arm length. 

In the past, I have also opted to attach the longer arm from the original operator to a new style like the 39-031 using the 62-014 rivet. Ultimately, it is up to you and which replacement method you are most comfortable with.
