opening of the latch is smaller on the new handle(38-306)

Question

latch will not lock in place. looks to us that the opening is not wide enough.

The original lock you show is no longer available, I'm afraid. The manufacture suggests the 38-036 as a replacement. In the past, I have personally used the 38-036 with no problem. See if the strike/keeper in the window needs to be adjusted. The could have been why your original lock broke.
