It could be that your stationary door is not set in the correct location. From the outside, close your sliding patio door and see were it hits on the stationary door. Check to see if it is at the top or bottom of the frame. My thinking is that you might have a stationary door clip that is not secured, and those are always installed at either the top or bottom of the frame. 

If you don't have a clip take a look at the 82-059 or the 80-059 to see if one of these will secure the door in the correct location so as to not hit the moving door.
